By downloading, accessing, or using Bazarly, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services. These terms constitute a legally binding agreement between you and the operator of the Bazarly platform.
Bazarly is operated by Bazarly Ltd, a company registered in the Republic of Cyprus. Bazarly is a peer-to-peer (C2C) local marketplace platform enabling private individuals to post, browse, and respond to classified listings for goods in Cyprus. Bazarly provides the technology platform only. We are not a party to any transaction between users, do not transfer title of any goods, and do not process, hold, or facilitate any financial payments. All payment arrangements are made directly and exclusively between buyers and sellers.
You must be at least 18 years of age to create an account or post listings. By using Bazarly you confirm you meet this requirement. We reserve the right to request age verification and to terminate accounts where this requirement is not met.

Bazarly is not a party to any transaction and has no liability for any loss arising from transactions conducted through the platform.
The following may not be listed on Bazarly under any circumstances:
Basic listing on Bazarly is free. Bazarly may offer optional paid promotional services (such as featured placement). Any fees for such services will be clearly disclosed before purchase. All fees are non-refundable unless otherwise stated. We reserve the right to update our fee structure by providing reasonable advance notice. Bazarly does not process, handle, or take any commission on payments between users.
All content, features, and functionality of the Bazarly platform (including its name, logo, design, software, and text) are owned by or licensed to Bazarly and protected by copyright, trademark, and other applicable laws. You retain ownership of content you post but grant Bazarly a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute that content solely for the purpose of operating and promoting the platform. You warrant that you own or have the right to use any content you post.
In accordance with the EU Digital Services Act (Regulation (EU) 2022/2065), Bazarly:
When we restrict, remove content, or suspend an account, we will provide a clear explanation. You have the right to appeal any such decision by emailing bazarly@bazarly.app within 14 days of receiving the notification. We will review your appeal and respond within 15 business days.
If you encounter content you believe is illegal or violates these terms, report it via the in-app reporting feature or by emailing bazarly@bazarly.app. We will acknowledge your report and take appropriate action. We do not tolerate retaliatory action against users who make good-faith reports.
In accordance with EU Platform-to-Business Regulation (EU) 2019/1150, the main parameters that determine listing display order are: recency of posting, relevance to search terms, and whether the seller has purchased optional paid promotion. Paid promotion causes a listing to appear more prominently than it would based on organic ranking. We do not use undisclosed personalised ranking based on user profiling.
We may restrict, suspend, or terminate your account where we have reasonable grounds to believe you have violated these terms or applicable law. Where possible, we will provide prior notice and an opportunity to remedy the issue. For serious violations (fraud, illegal content, abuse), immediate suspension may occur without prior notice. You may appeal any restriction by emailing bazarly@bazarly.app. Upon termination you may request deletion of your data in accordance with our Privacy Policy.
If you are a consumer resident in the European Union, nothing in these terms limits or excludes rights you hold under applicable EU or Cyprus consumer protection law, including the Consumer Rights Directive (2011/83/EU) and the Unfair Contract Terms Directive (93/13/EEC). Any provision found to conflict with mandatory consumer protection law shall be void to the extent of that conflict only.
As a platform operating in the European Union, Bazarly may be required under EU Directive 2021/514 (DAC7) to collect information about sellers and report certain seller activity to the Cyprus Tax Department. Where applicable, we will notify affected sellers and collect the information required by law. Sellers are independently responsible for declaring and paying all taxes applicable to their sales activity.
Bazarly is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free. This disclaimer applies to the maximum extent permitted by applicable law.
To the maximum extent permitted by Cyprus and EU law, Bazarly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption. Our total aggregate liability to you for direct damages shall not exceed €100 or the amount you paid to Bazarly in the preceding 12 months, whichever is greater. Nothing in this clause limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
You agree to indemnify and hold harmless Bazarly, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your listings, your transactions with other users, or your violation of these terms or applicable law.
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Cyprus. Where mandatory EU law applies, it shall take precedence.
We encourage you to contact us first at bazarly@bazarly.app to resolve any dispute amicably. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Cyprus.
If you are an EU consumer, you also have the right to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Nothing in this clause prevents you from bringing proceedings before the courts of your country of residence where required by EU law.
By creating an account or using our platform, you agree that we may contact you through the communication channels you provide. These communications may include:
These communications are essential for operating the platform and cannot be opted out of while your account or listings remain active. If you do not wish to receive them, you must delete your account and remove your listings.
We may also send optional promotional or marketing communications. You may opt out at any time by following the unsubscribe instructions or adjusting your account settings.
We may modify these terms at any time. For material changes we will provide at least 15 days' advance notice via email or in-app notification before the changes take effect. Continued use of Bazarly after that date constitutes acceptance. If you do not accept the changes, you must stop using the platform and may delete your account.
